10：04　大村証人入廷、証人宣誓後、検察側（岡本検察官）より主尋問開始
　　　　証人は公認会計士であって、平成電電株式会社の会計監査を担当しました。公認会計士の資格を取得したのは、昭和60年に公認会計士2次試験
に合格、平成元年に3次試験に合格、その後公認会計士として、勤務、職歴は昭和60年に朝日監査法人、平成8年に太陽監査法人に入社し、現在に至って
います。
　　　　平成電電株式会社の監査を担当したのは、平成15年の4月・5月から平成17年の4月までです。つまり、（平成電電の決算期に合わせると）、
平成16年1月期（決算）と平成17年1月期（決算）を担当しましたということになります。平成15年の1月期はその前任者である「新日本監査法人」が担当
していました。（証人が）平成電電株式会社の担当者と初めて接触したのは、平成15年3月頃です。その担当者という人が「みずほ銀行の北本氏」と熊本
徳夫氏でした。北本氏はその時の名刺交換をした時のものが「みずほ銀行」でしたが平成電電株式会社に転籍して間もなくのことだったようです。
　その新日本監査法人が監査をやっていて、辞任をしたので、その代りに監査をやることになりました。平成電電の方からは、平成15年の1月からやってくれないか
と言われましたが、もうその時は平成15年1月期を超えているので、来年の平成16年1月期からやることになりました。

        The witness was a certified public accountant, and it took charge of the audit of Denden Ltd. of the Heisei era. The second certified public accountant examination of acquisition of certified public accountant's qualification in 1985
It passes the third examination in passing and 1989, it joins morning sun Audit Corporation work and the business career as a certified public accountant in 1985 afterwards, it joins sun Audit Corporation in 1996, and it arrives now.

It did. (The witness :. )It is about in March, 2003 that came in contact for the first time with the person in charge of Denden Ltd. of the Heisei era. The person who is the person in charge is "Mr. Kitamoto of Mizuho Bank" and Kumamoto.
It was Tocot. Mr. Kitamoto was to have cried because he transfered his domicile to Denden Ltd. of the Heisei era though was "Mizuho Bank" the one when business cards were exchanged at that time.
  The new Japanese Audit Corporation is auditing, and it will audit it to the taking the place because it resigned. Will you do from Heisei era Denden in January, 2003?
Because the period on January, 2003 is exceeded at that time already, it will do for the period on January, 2004 next year though it was said.

平成電電事件/被告人佐藤賢治第9回公判（刑事裁判）その2結果と今後の予定

標記の平成電電匿名組合詐欺被告事件（被告人　佐藤賢治　元平成電電株式会社代表取締役）第9回公判（証人尋問）刑事裁判が
東京地方裁判所429号法廷で10：00〜16：04（途中昼と14：30〜15：04が休憩）まで行われました。
　今回は予告どおり、公認会計士が2名
　　、1人目（午前中）は検察側申請証人である、大村公認会計士（当時の名称での太陽監査法人勤務で平成16年度と平成17年度の平成電電株式会社の決算を担当）
　　　
　　　2人目（午後）は弁護人申請側証人である、クルマ公認会計士（弁護人からの専修大学でのつきあいでの依頼で平成20年以降に指定された段ボール箱4個〜5個における平成電電株式会社の決算書類の解析を担当）

　上記の形で行われました。
　午前中の証言では主に次の内容でした。太陽監査法人に勤務する証人は平成15年度から平成16年度に跨ぐ時の前任者であった新日本監査法人からの平成電電株式会社における監査担当の引き継ぎをしました。そして、平成16年度と平成17年度の2年間を担当したが、平成15年に引き続きなお、2年連続で「意見不表明」という結論を出さざるをえませでした。それは、決算期日を考えた指示する期日までに平成電電の経理部門から決算に必要な書類をもらうことができなかったことと修正するように指示した部分が改善されなかったためです。仮にそれがキチンと実行された場合の平成電電の平成１７年１月期の財務状況は約８０億円の「債務超過」に陥る状況となります。
　また、平成16年の中ごろから、平成電電はこの状態がこのまま続くと（倒産の寸前の意味をなす状態を示す）「継続の疑義」（けいぞくのぎぎ）ということを表明（平成17年度決算において）しなければならないことになるだろう、ということを平成電電の経理担当者に伝えました。

　午後の証人では主に次の内容でした。平成20年になって、弁護人から解読するのに難しいとされる書類（主に平成電電株式会社の会計関係の書類で単ボール箱で４から５個）を会計士的に分析・整理して意見を加えるという事を（弁護人と同じ大学の「専修大学」の誼で）依頼されました。
　　それらをまとめたものが「弁１号証」となるもので、それは平成１７年１月期と平成１８年１月期の財務内容を分析・整理して、それに意見をつけたものです。それらのソースは「総勘定元帳」です。その他のものは、整合性があわずブレが生じていてまるで「ごみ箱」を見ているかのようなので、分析不可能と（証人は）判断しました。
　そして平成電電の大きな収入源としてドリームテクノロジーズ株式会社の株式（後の検察からの反対尋問で平成電電の関連会社の株式の計上についての規則から矛盾を指摘される）が５０数億円と評価できる収入がありました。
　しかし検察側の反対尋問では、証人が平成電電の状況やしりょうについて知っている事柄があまりにも乏しく、その上での分析と報告なので、平成電電の財務状況がかなり厳しいとは言えないという報告は信用できないという指摘をうけ、結果として「平成電電の財務状況はよくわからない」というのがその報告書の正しい結果だということも指摘されました。

　次回第１０回は平成２１年２月１７日（火）は１０：００〜１２：００
　　　　第１１回は平成２１年２月１８日（水）で１０：００〜１７：００で両者とも佐藤賢治被告人に対する質問（被告人質問）
になります。
　そして、以前行われなかった弁護人側の証人尋問は、まだはっきりと決まらない状況で、次回と次次回の中での設定も考えているとのことでした。
